A.E. v. HHS - HPV, other (2021)

Elizabeth Eshelman, on behalf of her minor child A.E., filed a petition on November 12, 2020, alleging that A.E. suffered an adverse reaction to a Gardasil vaccination received on November 7, 2018. The case proceeded under the National Vaccine Injury Compensation Program.

As no decision on the merits had been issued within the time specified by Vaccine Rule 10(b), a notice was issued on July 12, 2021, informing the parties of the option to withdraw the petition or have it remain before the Special Master. On August 5, 2021, Petitioner elected to withdraw the petition pursuant to 42 U.S.C. § 300aa-21(b).

The Special Master granted the withdrawal request, concluding the proceedings. No judgment on the merits was entered.
