H.W. v. HHS - HPV, other (2021)

Ken and Shaun Wingerter, on behalf of their minor child H.W., filed a petition on October 16, 2020, alleging H.W. suffered an adverse reaction to a Gardasil vaccination administered on August 20, 2018. The statutory 240-day period for issuing a decision expired without a ruling.

Petitioners were notified of this and their right to withdraw the petition. On July 6, 2021, Petitioners filed a notice of intent to withdraw their petition, exercising their right under 42 U.S.C. § 300aa-21(b).

The Special Master granted their request to withdraw. Accordingly, proceedings on the merits of the petition were concluded, but no judgment on the merits was entered.
