Jeanette Peregoy v. HHS - Influenza, shoulder injury related to vaccine administration (SIRVA) (2022)

Jeanette Peregoy filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging that she suffered a shoulder injury related to vaccine administration (SIRVA) after receiving an influenza vaccine on September 27, 2016. She further alleged that she experienced residual effects of this condition for more than six months.

The respondent, the Secretary of Health and Human Services, denied that Ms. Peregoy sustained a SIRVA Table injury, denied that the vaccine caused her alleged shoulder injury or any other injury, and denied that her current condition was a sequela of a vaccine-related injury.

Despite these denials, the parties filed a joint stipulation agreeing to settle the case and award compensation. The court adopted the stipulation, awarding Ms.

Peregoy a lump sum of $110,000.00. This amount represents compensation for all items of damages available under Section 15(a) of the Vaccine Act.

The case proceeded as a Table claim, as SIRVA is listed on the Vaccine Injury Table. The stipulation also addressed future proceedings for attorneys' fees and costs.
