Aliaksandr Kavaliou v. HHS - HPV, left shoulder injury related to vaccine administration (SIRVA) (2026)

Aliaksandr Kavaliou filed a petition alleging that he suffered a left shoulder injury related to vaccine administration (SIRVA) as a result of an HPV vaccine he received on December 16, 2021. Respondent argued that Petitioner could not establish the onset of his left shoulder pain within 48 hours of vaccination, as required for a Table SIRVA claim.

Petitioner stated in his declaration that he immediately felt strange pain after the vaccination and could not move his left arm or hand without pain. He sought treatment for his shoulder pain on January 26, 2022, approximately 41 days after the vaccination.

The Special Master found that the totality of the evidence, including Petitioner's declaration and medical records, favored Petitioner's contention that the onset of his left shoulder pain occurred within 48 hours of vaccination. The Special Master encouraged the parties to attempt settlement and ordered Respondent to file a status report on how he intended to proceed.
