Kelly McClusky v. HHS - HPV, other (2023)

Kelly McClusky filed a petition on behalf of her minor child, L.M., alleging injury following an HPV vaccination on December 1, 2020. The petition was filed on November 18, 2022.

Because no decision had been issued within the time specified by Vaccine Rule 10(b), a notice was issued advising the petitioner of her options to either withdraw the petition or have it remain before the special master. On July 17, 2023, Petitioner elected to withdraw the petition.

The Chief Special Master granted the withdrawal request, concluding the proceedings on the merits. No judgment on the merits was entered.
