Michelle Smith v. HHS - HPV, other (2023)

Michelle Smith filed a petition on behalf of her minor child, J.S., alleging injury following an HPV vaccination on November 27, 2019. The petition was filed on May 19, 2022.

Because no decision had been issued within the time specified by Vaccine Rule 10(b), a notice was issued advising the petitioner of her options to withdraw the petition or have it remain before the special master. On May 15, 2023, Petitioner elected to withdraw the petition.

The Chief Special Master granted the withdrawal request, and the proceedings on the merits were concluded. No judgment on the merits was entered.
