Rita Martins v. HHS - HPV, other (2023)

Rita Martins filed a petition on behalf of her minor child, Z.M., alleging injuries after receiving human papillomavirus (HPV) vaccinations on March 6, 2019, and March 6, 2020. The petition was filed on March 7, 2023.

Because a decision had not been issued within the time specified by Vaccine Rule 10(b), the petitioner was notified that she could withdraw the petition or have it remain before the special master. On March 6, 2023, Rita Martins elected to withdraw the petition.

The Chief Special Master granted the withdrawal request, concluding the proceedings on the merits. No judgment on the merits was entered.
