N.F. v. HHS - HPV, death (2022)

Clifton and Kelli Foley filed a petition on behalf of their minor child, N.F., alleging that N.F. suffered injuries after receiving a human papillomavirus vaccination on May 7, 2018, which ultimately led to the child's death. The petition was filed on February 9, 2022.

Because a decision had not been issued within the time specified by Vaccine Rule 10(b), a notice was issued advising that the petitioners could withdraw the petition or have it remain before the special master. On January 8, 2022, the petitioners timely filed a notice to withdraw the petition.

The Chief Special Master granted the request to withdraw the petition, and therefore, proceedings on the merits of the petition were concluded. No judgment on the merits was entered.
