Mengyao Hu v. HHS - HPV, myofasciitis and other injuries (2021)

Mengyao Hu filed a petition on March 1, 2019, alleging that she suffered myofasciitis and other injuries as a result of the HPV vaccine she received on August 19, 2015. The respondent argued that the medical records did not establish myofasciitis and questioned the temporal relationship, noting that joint pain appeared to begin approximately 15 months after vaccination.

Ms. Hu was ordered to provide further information and an expert report, but she failed to comply with court orders and was difficult to contact.

Her counsel reported being unable to locate or contact Ms. Hu for several months and was unable to produce an expert report.

The court found that Ms. Hu failed to prosecute her case and did not provide sufficient evidence, such as medical records or a competent physician's opinion, to support her claim.

Consequently, the case was dismissed for failure to prosecute and insufficient proof.
