Wendell Davis v. HHS - Tdap, macrophagic myofasciitis (2018)

Wendell Davis filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging injury from Hepatitis A and Tdap vaccinations received on August 13, 2014. He claimed to have suffered from macrophagic myofasciitis (MMF) with residual effects lasting over six months.

The petition was filed on June 29, 2016. Respondent denied that the vaccines caused MMF or any other injury.

However, the parties reached a joint stipulation to settle the case. The stipulation awarded Mr.

Davis a lump sum of $1,150,000.00 to cover first-year life care expenses, past and future lost earnings, past unreimbursed expenses, and pain and suffering. Additionally, an amount sufficient to purchase an annuity contract for future medical expenses was awarded.

The decision adopting the stipulation was issued on November 26, 2018. The case proceeded as a Table claim, as the Hepatitis A and Tdap vaccines are listed on the Vaccine Injury Table.
