Sherry Gomes v. HHS - Influenza, shoulder injury related to vaccine administration (SIRVA) (2026)

Sherry Gomes filed a petition for compensation under the National Vaccine Injury Compensation Program on December 9, 2025, alleging that she suffered a shoulder injury related to vaccine administration (SIRVA) as a result of an influenza vaccine administered on August 26, 2024. She stated that the vaccine was administered in the United States, that she suffered residual effects for more than six months, and that she had received no prior settlements or awards for this injury.

Respondent filed a Rule 4(c) report on June 3, 2026, conceding that Petitioner is entitled to compensation. Respondent concluded that Petitioner's injury meets the requirements of a SIRVA Table injury and that she has satisfied all other requirements for compensation under the Vaccine Act.

Based on Respondent's concession and the evidence, the Chief Special Master found Petitioner entitled to compensation.
