RULING ON ENTITLEMENT1 On July 25, 2025, Kim Dunn, as administrator of the estate of Otto Schawb, deceased, filed a petition for compensation under the National Vaccine Injury Compensation Program, 42 U.S.C. §300aa-10, et seq.2 (the “Vaccine Act”). Petitioner alleges that that Mr. Schwab suffered from Guillain-Barre Syndrome (“GBS”) following an influenza vaccination he received on October 31, 2024. Petition at 1. Petitioner further alleges that Mr. Schwab died from his vaccine-related injury. Id. at ¶ 13. Respondent’s Rule 4(c) Report at 1. Specifically, Respondent states that it is his “position that Petitioner has satisfied the criteria set forth in the Vaccine Injury Table (Table) and the Qualifications and Aids to Interpretation (QAI), which afford Petitioner a presumption of causation is the onset of GBS occurs between three and forty-two days after a seasonal flu vaccination and there is no apparent alternative cause”. Id. at 3. Respondent also states that Mr. Schwab “more likely than not died as a result of his presumptive GBS.” Id. Respondent finally agrees that, “based on the current record, Petitioner has satisfied all legal prerequisites for compensation under the Act.” Id.
