She stated the vaccine was administered in the United States, she suffered residual effects for more than six months, and no prior action or compensation had been sought for this injury. Respondent filed a Rule 4(c) report conceding that Petitioner is entitled to compensation for a Table SIRVA. Respondent noted that Petitioner had no prior shoulder issues, the pain occurred within 48 hours after vaccination, and the pain was limited to the side of administration, with no other condition explaining the symptoms. Respondent also agreed that Petitioner suffered residual effects for more than six months and met all Vaccine Act requirements. Based on Respondent's concession and the record, Chief Special Master Corcoran found Petitioner entitled to compensation. Case 1:25-vv-00354-UNJ Document 31 Filed 07/30/26 Page 2 of 2 On June 26, 2026, Respondent filed his Rule 4(c) report in which he concedes that Petitioner is entitled to compensation in this case. Respondent’s Rule 4(c) Report at 1-2. Specifically, Respondent recommends that Petitioner be found entitled to compensation for a Table SIRVA because “Petitioner had no history of pain, inflammation, or dysfunction of her right shoulder prior to vaccination that would explain petitioner’s post-vaccination symptoms; shoulder pain occurred within forty-eight hours after receipt of an intramuscular Tdap vaccination; shoulder pain and reduced ROM were limited to the side in which the vaccine was administered; and no other condition or abnormality has been identified to explain petitioner’s shoulder pain.” Id. at 5. Respondent further agrees that Petitioner suffered residual effects of her condition for more than six months, and has satisfied all requirements for compensation under the Vaccine Act. Id. In view of Respondent’s position and the evidence of record, I find that Petitioner is entitled to compensation. IT IS SO ORDERED. s/Brian H. Corcoran Brian H. Corcoran Chief Special Master 2
