Jennifer Gagliardi v. HHS - Influenza, shoulder injury related to vaccine administration (SIRVA) (2025)

Jennifer Gagliardi filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging she suffered a shoulder injury related to vaccine administration (SIRVA) as a result of an influenza vaccine received on October 26, 2022. The respondent conceded that her alleged injury was consistent with SIRVA as defined by the Vaccine Injury Table and that she suffered residual effects for more than six months.

A ruling on entitlement was issued on December 18, 2024, finding her entitled to compensation. Subsequently, on March 11, 2025, the respondent filed a proffer on award of compensation, proposing an award of $78,000.00 for pain and suffering and $5,829.24 for past unreimbursable expenses.

Petitioner agreed with the proffered award. On April 25, 2025, the Chief Special Master issued a decision awarding Jennifer Gagliardi a total of $83,829.24, representing the agreed-upon amounts for pain and suffering and past unreimbursable expenses.

This award is intended to compensate for all damages available under the Act.
