Robert M. Anderson, Jr. v. HHS - Influenza, right shoulder injury related to vaccine administration (SIRVA) (2025)

On September 6, 2023, Robert M. Anderson, Jr., then 37 and incarcerated, filed a petition alleging that an influenza vaccine administered on January 12, 2021 caused a right shoulder injury related to vaccine administration.

Mr. Anderson's prison medical records began two days later, when he reported right shoulder pain while using an exercise bicycle.

Over the following months he repeatedly sought health services for pain, weakness, limited overhead use, and difficulty exercising. He was evaluated by prison medical staff, received x-rays and ultrasound imaging, was referred for physical therapy, and later saw orthopedist Dr.

Edward Riley. A March 2022 MRI and continued symptoms led to shoulder surgery in November 2022, where the operative findings included chronic subacromial bursitis, severe AC-joint osteoarthritis, synovitis, a partial-thickness rotator cuff tear, and superior labral fraying.

He continued postoperative therapy and later received an AC-joint steroid injection that provided substantial relief. Respondent conceded entitlement in May 2024, and Chief Special Master Brian H.

Corcoran found Mr. Anderson entitled to compensation.

At damages, Mr. Anderson sought $140,000.00 to $150,000.00 for pain and suffering, while respondent proposed no more than $100,000.00.

After a damages hearing, Chief Special Master Corcoran awarded $133,000.00 for past pain and suffering on October 27, 2025.
