Nicole Martelli v. HHS - HPV, other (2024)

Nicole Martelli filed a petition for compensation on behalf of her minor child, S.M., alleging injuries after receiving human papillomavirus (HPV) vaccinations on May 12, 2020, and November 12, 2020. The petition was filed on June 30, 2023.

Because no decision on the merits had been issued within the time specified by Vaccine Rule 10(b), the petitioner was notified of her options to either withdraw the petition or have it remain before the special master. On February 27, 2024, Nicole Martelli elected to withdraw the petition.

The Chief Special Master granted the withdrawal request and ordered that proceedings on the merits be concluded, but no judgment on the merits should be entered. The case was therefore dismissed upon withdrawal.
