Caesar Martinez v. HHS - HPV, other (2023)

Caesar Martinez filed a petition on January 17, 2023, on behalf of his minor child, V.M., alleging injury following a human papillomavirus vaccination on March 31, 2020. The petition was filed under the National Vaccine Injury Compensation Program.

Because no decision had been issued within the time specified by Vaccine Rule 10(b), a notice was issued. Petitioner then timely filed a notice to withdraw the petition on September 15, 2023, pursuant to 42 U.S.C. § 300aa—21(b).

The Chief Special Master granted the withdrawal request. Accordingly, proceedings on the merits of the petition were concluded, but no judgment on the merits was entered.
