Melinda McDonald v. HHS - Influenza, Myalgic Encephalomyelitis/Chronic Fatigue Syndrome and Cervical Dystonia (2024)

Melinda McDonald received an influenza vaccination on September 16, 2019. She alleged that this vaccination caused her to suffer from Myalgic Encephalomyelitis/Chronic Fatigue Syndrome and Cervical Dystonia.

Her petition was filed on August 3, 2022. On July 26, 2024, both Melinda McDonald and the Secretary of Health and Human Services filed a joint stipulation for dismissal.

Pursuant to Vaccine Rule 21(a), the parties agreed to dismiss the action voluntarily. The Court of Federal Claims, Office of Special Masters, dismissed the case without prejudice on July 30, 2024, and instructed that a judgment shall not enter.
