Megan Shipman v. HHS - other (2024)

Megan Shipman filed a petition for compensation under the National Vaccine Injury Compensation Program on July 25, 2021. The case progressed with Respondent filing a Rule 4 Report on February 23, 2023.

Subsequently, Petitioner filed a Notice of Voluntary Dismissal. However, because Respondent had already filed a Rule 4 Report, Petitioner could not procedurally voluntarily dismiss the case.

The Office of Special Master Staff Attorney advised Petitioner's counsel on alternative ways to exit the Vaccine Program. On July 23, 2024, Respondent filed a Joint Stipulation of Dismissal.

The Chief Special Master ordered the case dismissed without prejudice, with judgment not to be entered. Petitioner's Notice of Voluntary Dismissal was stricken from the record.
