Andrea P. Giguere v. HHS - Influenza, Guillain-Barré Syndrome (2023)

Andrea P. Giguere filed a petition for compensation under the National Vaccine Injury Compensation Program on September 22, 2021, alleging she developed Guillain-Barré Syndrome (GBS) as a result of receiving an influenza vaccine on September 25, 2018.

She further alleged residual effects from her GBS for more than six months. Respondent denied that GBS occurred within the Table timeframe and denied that the flu vaccine caused her alleged GBS or any other injury.

Despite these denials, the parties filed a joint stipulation on June 22, 2023, agreeing to a settlement. The court adopted the stipulation as its decision, awarding Andrea P.

Giguere $80,000.00 as a lump sum and an additional $316.40 to satisfy a State of Rhode Island Medicaid lien. These amounts represent compensation for all items of damages available under Section 15(a) of the Vaccine Act.

The parties also agreed to submit to further proceedings for reasonable attorneys' fees and costs.
