The petition stated that his symptoms persisted for more than six months. Respondent filed a Rule 4(c) report conceding that Mr. Peterson is entitled to compensation, agreeing that he satisfied the criteria set forth in the Vaccine Injury Table and Qualifications and Aids to Interpretation, which afford a presumption of causation for GBS. A ruling on entitlement was issued on August 31, 2022, finding Mr. Peterson entitled to compensation. Subsequently, on March 31, 2023, Respondent filed a proffer on award of compensation, recommending an award of $170,291.00, which Petitioner agreed to. This amount was comprised of $152,500.00 for pain and suffering, $11,040.35 for past unreimbursable expenses, and $6,750.65 for past lost wages. The decision awarding damages was issued on May 4, 2023, granting the lump sum payment to Mr. Peterson, who is a competent adult.
