Angela Wilson-Noble v. HHS - Influenza, Guillain-Barré Syndrome (“GBS”) and/or Acute or Chronic Inflammatory Demyelinating Polyneuropathy (“AIDP” and “CIDP”) (2024)

Angela Wilson-Noble filed a petition for compensation on June 29, 2021, alleging that she developed Guillain-Barré Syndrome (GBS) and/or Chronic Inflammatory Demyelinating Polyneuropathy (CIDP) as a result of an influenza vaccine received on October 15, 2019. The case has been pending for nearly three years, involving extensive medical record submissions and expert reports from both parties.

Respondent initially indicated amenability to informal resolution but later recommended against compensation. The parties have scheduled a two-day entitlement hearing for August 18 and 19, 2026.

Petitioner is seeking an award of interim attorneys' fees and costs, totaling $110,756.11, due to the protracted nature of the litigation and the significant costs incurred. The Special Master found that interim fees and costs were warranted due to the undue hardship the ongoing litigation would impose on the petitioner.

The requested hourly rates for counsel and staff were found to be consistent with previous awards, and the hours expended were deemed reasonable. Costs, including expert fees for Dr.

Lawrence Steinman and travel expenses, were also reviewed and found reasonable. The Special Master granted the motion, awarding $95,763.00 in attorneys' fees and $14,993.11 in costs, for a total award of $110,756.11.
