Thomas Burbank v. HHS - Tdap, Guillain-Barré syndrome (GBS) and/or chronic inflammatory demyelinating polyneuropathy (CIDP) (2023)

Thomas Burbank filed a petition alleging that he suffered from Guillain-Barré syndrome (GBS) and/or chronic inflammatory demyelinating polyneuropathy (CIDP) as a result of receiving a Tdap vaccine on September 18, 2018. The respondent, the Secretary of Health and Human Services, denied that the vaccine caused Mr.

Burbank's condition. Despite maintaining their respective positions, the parties reached a stipulation to settle the case and award compensation.

The stipulation stated that a decision should be entered awarding Mr. Burbank compensation.

The parties agreed that the award would be a lump sum of $110,000.00, intended to compensate for all damages available under the National Vaccine Injury Compensation Program. The Special Master adopted the stipulation and ordered that judgment be entered in accordance with its terms.

The case was resolved via stipulation, with compensation awarded to the petitioner.
