Melly Grizzell v. HHS - Tdap, left shoulder injury related to vaccine administration (SIRVA) (2023)

Melly Grizzell filed a petition for vaccine compensation on April 13, 2021, alleging that she suffered a shoulder injury related to vaccine administration (SIRVA) from a tetanus diphtheria acellular pertussis (Tdap) vaccine she received on July 23, 2020. The Tdap vaccine is listed on the Vaccine Injury Table.

Ms. Grizzell stated that her symptoms persisted for more than six months and that she had not filed any other action or received compensation for this injury.

Respondent denied that Ms. Grizzell sustained a SIRVA Table injury or that the vaccine caused her condition.

Despite these differing positions, the parties filed a joint stipulation on January 19, 2023, agreeing to settle the case and award compensation. The Chief Special Master adopted the stipulation, awarding Ms.

Grizzell a lump sum of $25,000.00 for all damages. This amount represents compensation for all items of damages available under Section 15(a) of the Vaccine Act.

The decision was entered on February 28, 2023.
