Naho Miyachi v. HHS - Tdap, shoulder injury related to vaccine administration (SIRVA) (2025)

Naho Miyachi filed a petition for vaccine compensation on March 10, 2021, alleging that the Tdap vaccine she received on April 5, 2018, caused her to suffer from a shoulder injury related to vaccine administration (SIRVA). The Tdap vaccine is contained in the Vaccine Injury Table.

Ms. Miyachi represented that she had not received any prior award or settlement for her condition.

The respondent, the Secretary of Health and Human Services, denied that Ms. Miyachi sustained a SIRVA Table injury, denied that the Tdap vaccine caused her alleged shoulder injury or any other injury, and denied that her current condition was a sequela of a vaccine-related injury.

Despite these differing positions, the parties reached a joint stipulation to settle the case. The stipulation was adopted as the decision of the Court.

Ms. Miyachi was awarded a lump sum payment of $45,000.00 as compensation for all damages available under the program.

This award represents a negotiated settlement of liability and damages.
