Jennifer Glover v. HHS - Tdap, left shoulder injury related to vaccine administration (SIRVA) (2023)

Jennifer Glover filed a petition for compensation under the National Vaccine Injury Compensation Program alleging that she suffered a left shoulder injury related to vaccine administration (SIRVA) caused by a tetanus, diphtheria, acellular pertussis (Tdap) vaccine she received on February 21, 2020. The petition stated that she received the vaccine within the United States, suffered residual effects for more than six months, and had not filed a civil action or received other compensation for the injury.

The case was assigned to the Special Processing Unit. On March 17, 2023, the Secretary of Health and Human Services filed a Rule 4(c) report conceding that Petitioner was entitled to compensation for SIRVA, a defined Table injury.

Based on this concession and the evidence, a ruling on entitlement was issued finding Petitioner entitled to compensation. Subsequently, on April 3, 2023, Respondent filed a proffer on award of compensation, recommending an award of $65,000.00 for pain and suffering, which Petitioner agreed to.

The Chief Special Master issued a decision awarding Petitioner a lump sum payment of $65,000.00.
