Barbara Benson v. HHS - Influenza, left shoulder injury related to vaccine administration (2022)

Barbara Benson filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging she suffered a left shoulder injury related to vaccine administration (SIRVA) after receiving the influenza vaccine on October 12, 2019. She stated that she received the vaccine in the United States, suffered residual effects for more than six months, and had not filed a civil suit or received other compensation for her injury.

Respondent conceded that Petitioner is entitled to compensation, agreeing that her SIRVA is a defined Table injury. A ruling on entitlement was issued on April 26, 2022, finding Petitioner entitled to compensation.

Subsequently, on July 18, 2022, Respondent filed a proffer recommending an award of $61,740.66, comprising $60,000.00 for pain and suffering and $1,740.66 for past unreimbursable expenses. Petitioner agreed with this proffered award.

Chief Special Master Corcoran issued a decision awarding Petitioner the lump sum of $61,740.66.
