Teresa Mazza v. HHS - Influenza, right shoulder bursitis and shoulder dysfunction (2025)

On October 7, 2020, Teresa Mazza filed a petition alleging that an influenza vaccination administered in her right arm on October 11, 2018 caused a shoulder injury. Her Table SIRVA claim was dismissed after a findings-of-fact ruling because the record did not support onset within 48 hours.

She continued on a causation-in-fact theory. The records described right-shoulder problems before and after vaccination.

Before the flu shot, she had reported right-sided pain in January 2018. After vaccination, the contemporaneous records did not document immediate shoulder pain.

The later litigation focused on whether the vaccine could still be linked to bursitis and right-shoulder dysfunction despite delayed documented onset. Respondent opposed entitlement.

Special Master Daniel T. Horner found that the Table claim failed but that the evidence supported an off-Table injury caused by vaccination.

On September 10, 2025, Special Master Horner granted entitlement on the off-Table theory. Respondent then proffered damages, and Ms.

Mazza accepted. On November 5, 2025, she was awarded $115,373.33, consisting of $110,000.00 for pain and suffering and $5,373.33 for past unreimbursable expenses.
