Michael W. Gladish v. HHS - Tdap, shoulder injury related to vaccine administration (SIRVA) (2022)

Michael W. Gladish filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging he suffered a debilitating shoulder injury as a result of a Tdap vaccine he received on June 10, 2019.

He further alleged that he experienced residual effects of this injury for more than six months. Respondent denied that the vaccine caused the alleged shoulder injury or any other injury.

The parties filed a joint stipulation agreeing that a decision should be entered awarding compensation. The stipulation stated that the Tdap vaccine is contained in the Vaccine Injury Table and that the petitioner sustained a shoulder injury related to vaccine administration (SIRVA).

Pursuant to the stipulation, the court awarded Michael W. Gladish a lump sum of $50,000.00 as compensation for all damages available under the Vaccine Act.

The parties also agreed to further proceedings to award reasonable attorneys' fees and costs.
