DECISION ON JOINT STIPULATION1 On July 30, 2020, petitioner filed a petition on behalf of her deceased husband, Darryl Waldron (“decedent”), for compensation under the National Vaccine Injury Compensation Program, 42 U.S.C. §300aa-10, et seq.,2 (the “Vaccine Act”). Petitioner alleges that the decedent suffered Guillain-Barre Syndrome (“GBS”) within the time period set forth in the Vaccine Injury Table relative to an influenza (“flu”) vaccination that he received on December 5, 2017. Petition at 1; Stipulation, filed October 21, 2024, at ¶¶ 2-4. Petitioner alleges that decedent’s illness resulted in his death. She further alleges that there has been no prior award or settlement of a civil action for damages as a result of his condition and that his vaccine was administered in the United States.
