Ronald Tanski v. HHS - Tdap, Shoulder Injury Related to Vaccine Administration (SIRVA) (2022)

Ronald Tanski filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging that he suffered a left shoulder injury related to vaccine administration (SIRVA) after receiving a Tdap vaccine on October 12, 2018. He claimed this injury met the Table definition for SIRVA or, alternatively, was caused in fact by the vaccine.

Respondent denied that Mr. Tanski sustained a SIRVA Table injury or that the Tdap vaccine caused his alleged shoulder injury.

Despite these denials, the parties filed a joint stipulation agreeing that a decision should be entered awarding compensation. The court adopted the stipulation as its decision, awarding Mr.

Tanski a lump sum of $100,000.00. This amount represents compensation for all items of damages available under the Vaccine Act.

The decision was entered on September 12, 2022, following the petition filed on April 30, 2020.
