The respondent conceded that Mr. Motsett was entitled to compensation, as his condition met the criteria set forth in the Vaccine Injury Table. Specifically, the respondent noted that the onset of GBS occurred between three and forty-two days after the seasonal flu vaccination, with no apparent alternative cause. Based on the respondent's concession and the evidence of record, the court issued a ruling on entitlement, finding Mr. Motsett eligible for compensation. Subsequently, the parties reached a stipulation for damages. The respondent proffered an award of $130,888.20, which included $127,500.00 for pain and suffering and $3,388.20 for past unreimbursable expenses. Mr. Motsett agreed to this award. The court issued a decision awarding the lump sum payment of $130,888.20 to Mr. Motsett.
