Janel Viehman v. HHS - Influenza, left shoulder injury related to vaccine administration (SIRVA) (2022)

Janel Viehman filed a petition for vaccine compensation on March 19, 2020, alleging a left shoulder injury related to vaccine administration (SIRVA) after receiving an influenza vaccine on October 17, 2018. She claimed residual effects for more than six months.

The respondent denied that the petitioner sustained a SIRVA Table Injury, denied that the vaccine caused her alleged shoulder injury or any other injury, and denied that her current condition is a sequela of a vaccine-related injury. Despite these denials, the parties filed a joint stipulation on March 22, 2022, agreeing to settle the case.

Chief Special Master Brian H. Corcoran adopted the stipulation, awarding Janel Viehman $17,500.00 as compensation for all damages.

This amount represents a compromise of liability and damages. The case was treated as a Table claim.

The stipulation included a release of all claims related to the flu vaccination. Petitioner was represented by Leigh Finfer of Muller Brazil, LLP, and respondent was represented by Steven Santayana of the U.S.
