Toni Jefferson v. HHS - Tdap, left shoulder injury related to vaccine administration (SIRVA) (2022)

Toni Jefferson filed a petition for vaccine compensation on February 16, 2022, alleging that she suffered a left shoulder injury related to vaccine administration (SIRVA) as a result of a Tdap vaccine she received on May 16, 2018. She further alleged that she experienced the residual effects of her injury for more than six months.

Respondent denied that Ms. Jefferson sustained a SIRVA Table injury, denied that the Tdap vaccine caused her alleged shoulder injury or any other injury, and denied that her current condition was a sequelae of a vaccine-related injury.

Despite these denials, the parties filed a joint stipulation agreeing that a decision should be entered awarding compensation. The Chief Special Master adopted the stipulation as the decision, awarding Ms.

Jefferson a lump sum of $42,500.00. This amount represents compensation for all items of damages available under Section 15(a) of the Vaccine Act.

The parties agreed that this stipulation expressed a full and complete negotiated settlement of liability and damages claimed under the National Childhood Vaccine Injury Act.
