Maija Harkonen v. HHS - Influenza, left shoulder injury related to vaccine administration (SIRVA) (2021)

Maija Harkonen filed a petition for compensation under the National Vaccine Injury Compensation Program alleging that she suffered a left shoulder injury related to vaccine administration (SIRVA) caused by the trivalent influenza vaccine she received on October 12, 2016. The petition was filed on September 30, 2019.

Respondent conceded that Petitioner is entitled to compensation, stating that her injury satisfied the criteria set forth in the Vaccine Injury Table. A ruling on entitlement was issued on September 23, 2021, finding Petitioner entitled to compensation.

Subsequently, on October 6, 2021, Respondent filed a proffer on award of compensation, recommending an award of $86,526.34. This amount included $85,000.00 for pain and suffering and $1,526.34 for past unreimbursable out-of-pocket expenses.

Petitioner agreed with the proffered award. Chief Special Master Corcoran issued a decision awarding Petitioner the lump sum of $86,526.34 on November 9, 2021.

The award represented compensation for all damages available under Section 15(a) of the Vaccine Act.
