The Estate Of Apolinar Hasem Perdomo Feliz v. HHS - Influenza, Guillain-Barre syndrome (GBS) (2021)

The Estate of Apolinar Hasem Perdomo Feliz, through its administrator Bienchis Y. Esteva-Feliz, filed a petition for compensation under the National Vaccine Injury Compensation Program.

The petition alleged that Apolinar Hasem Perdomo Feliz received an influenza vaccine on March 12, 2017, and subsequently developed Guillain-Barre Syndrome (GBS), which led to his death on April 21, 2017. GBS is listed on the Vaccine Injury Table for the flu vaccine.

The respondent conceded entitlement to compensation, agreeing that the petitioner met the criteria for GBS under the Vaccine Injury Table. A ruling on entitlement was issued on May 19, 2020, finding the petitioner entitled to compensation.

This amount included a statutory death benefit of $250,000.00, compensation for past pain and suffering of $175,000.00, and $43,192.51 to satisfy a North Carolina Medicaid lien.
