George Garrison v. HHS - Influenza, shoulder injury related to vaccine administration (SIRVA) (2021)

George Garrison filed a petition for compensation on May 19, 2021, alleging he sustained a shoulder injury related to vaccine administration (SIRVA) after receiving an influenza vaccine on October 12, 2016. He further alleged that he experienced residual effects of this condition for more than six months.

The respondent denied that the petitioner sustained a SIRVA Table injury or that the flu immunization caused his injury. Nevertheless, the parties filed a joint stipulation agreeing to a settlement.

Chief Special Master Brian H. Corcoran adopted the stipulation as his decision.

The decision awarded George Garrison $36,000.00 as compensation for all items of damages available under Section 15(a). The case was processed as a Table claim, and the parties agreed to settle the issues of liability and damages.

Petitioner was represented by Paul R. Brazil of Muller Brazil, LLP, and respondent was represented by Camille Michelle Collett of the U.S.

Department of Justice. The award was to be paid as a lump sum in the form of a check payable to the petitioner.
