Marilyn Osborne Rock v. HHS - Influenza, Guillain-Barre Syndrome (GBS) (2019)

Anne M. Alexander, as personal representative of the Estate of Marilyn Osborne Rock, filed a petition for vaccine compensation on October 2, 2018.

The petition alleged that Marilyn Osborne Rock suffered Guillain-Barre Syndrome (GBS) as a result of an influenza vaccine administered on October 10, 2016. Petitioner further alleged that Ms.

Rock suffered residual effects of her GBS for six months and that her death was a sequela of her GBS. Respondent denied that Ms.

Rock's GBS lasted for at least six months and denied that her death was a sequela of a vaccine-related injury. Despite these disagreements, the parties filed a joint stipulation agreeing that a decision should be entered awarding compensation.

The court adopted the stipulation, awarding a lump sum of $75,000.00 to the Estate of Marilyn Osborne Rock for all items of damages. The case was brought as a Table claim, as GBS is listed on the Vaccine Injury Table for the influenza vaccine.
