Kristian M. Ellingsen v. HHS - Tdap, left shoulder bursitis or significant aggravation of a preexisting shoulder injury (2020)

Kristian Ellingsen, an adult, received a Tdap vaccine on November 22, 2016. He alleged that this vaccination caused him to suffer from left shoulder bursitis or a significant aggravation of a preexisting shoulder injury.

Mr. Ellingsen filed his petition for compensation with the National Vaccine Injury Compensation Program on March 22, 2018.

The parties, Kristian Ellingsen and the Secretary of Health and Human Services, reached a stipulation recommending an award of compensation. Although the respondent denied that the Tdap vaccine caused the alleged injury, they agreed to the stipulation.

The Special Master found the stipulation to be reasonable and adopted it as the decision of the Court. Mr.

Ellingsen was awarded a lump sum of $37,500.00 as compensation for all damages. The parties jointly filed notice renouncing the right to seek review, and judgment was entered accordingly.
