Valerie Newport v. HHS - Influenza, constant tremor in her right arm (2019)

Valerie Newport filed a petition on December 7, 2017, alleging she developed a constant tremor in her right arm after receiving an influenza vaccine on September 19, 2016. She submitted medical records, and Respondent filed a Rule 4(c) Report arguing she was not entitled to compensation.

Respondent noted that her injury was not a Table injury and that she had failed to present a reliable scientific theory supporting causation-in-fact. Following a status conference, Petitioner was directed to file an expert report.

However, unable to secure expert support, Petitioner filed a motion to dismiss her own claim. The Special Master found that Petitioner had not suffered a Table injury and that the record lacked sufficient evidence, including a medical expert's opinion, to establish that her alleged injury was caused by the vaccination.

Consequently, the Special Master dismissed the case.
