Michael Louie Vice v. HHS - Influenza, anaphylaxis and death (2024)

Peggy Vice, as legal representative of the Estate of Michael Louie Vice, filed a petition for compensation alleging that the influenza vaccine Mr. Vice received on October 22, 2015, caused him to suffer from anaphylaxis and die the following day.

The petition stated that the influenza vaccine is contained in the Vaccine Injury Table and that Mr. Vice's death was a sequela of the anaphylaxis.

Alternatively, the petitioner alleged that Mr. Vice suffered anaphylaxis, septic shock, and death caused-in-fact by the flu and/or pneumococcal vaccines.

Respondent denied that the vaccines caused Mr. Vice's alleged anaphylaxis, septic shock, or death.

The parties subsequently filed a joint stipulation concerning compensation. The Special Master found the stipulation reasonable and adopted it as the decision of the Court.

A lump sum of $117,500.00 was awarded to the petitioner, representing compensation for all damages available under the program. The decision was filed on October 10, 2024, and the petition was originally filed on October 19, 2017.
