D.r.-O. v. HHS - DTaP, seizure disorder and other injuries (2019)

Skye Robertson, mother and prochein ami for her minor child D.R.-O., filed a petition for compensation on March 9, 2017, alleging that D.R.-O. suffered a seizure disorder and other injuries as a result of receiving the DTaP vaccine on July 12, 2016. The parties filed a stipulation, and on September 26, 2019, the Special Master adopted it as her decision awarding compensation.

On July 12, 2019, Petitioner filed an application for attorneys' fees and costs, requesting a total of $17,934.34. Respondent indicated satisfaction that the statutory requirements for an award were met.

The Special Master reviewed the billing records and costs, finding the requested hourly rate of $250.00 for Mr. Dennis Potts reasonable, as were the hours expended (49.2) and the costs sought, which included acquiring medical records, postage, and expert witness fees.

The Special Master awarded the full requested amount of $17,934.34 for attorneys' fees and costs, payable jointly to Petitioner and her counsel.
