In returnforthepayments describedinparagraphs 8and12, petitioner,inher individual capacityandas legal representativesof B.B.,onbehalfofherself,B.B., and B.B.’s heirs,executors,administrators,successors or assigns,does foreverirrevocablyand 7 Case 1:17-vv-00295-UNJ Document 126 Filed 12/21/21 Page 11 of 13 unconditionallyrelease, acquit anddischargethe UnitedStates andtheSecretaryof Healthand HumanServices from anyand all actions orcauses ofaction(includingagreements,judgments, claims,damages,loss of services,expenses andall demands ofwhateverkindornature)that havebeenbrought,could havebeenbrought,orcouldbetimelybrought intheCourt ofFederal Claims,undertheNational Vaccine InjuryCompensationProgram,42U.S.C.§300aa-10et seq., onaccount of,orin anywaygrowingout of, anyandall knownorunknown,suspectedor unsuspectedpersonal injuries toordeathof B.B.resultingfrom,or alleged tohaveresultedfrom thevaccinationadministered onOctober15,2015, as alleged bypetitionerinapetitionfor vaccine compensationfiledonorabout March3, 2017,intheUnitedStates Court ofFederal Claims as petitionNo. 17-295V. 18. IfB.B.shoulddiepriortoentryofjudgment,this agreement shall bevoidableupon propernoticetotheCourt onbehalfofeitherorbothoftheparties. 19. Ifthespecial master fails toissueadecisionincompleteconformitywiththeterms ofthis StipulationoriftheCourt ofFederal Claims fails to enterjudgment inconformitywitha decisionthat is incompleteconformitywiththeterms ofthis Stipulation,then theparties’ settlement andthis Stipulationshall bevoidableat thesolediscretionofeitherparty. 20. This Stipulationexpresses afull and complete negotiated settlementof liabilityand damages claimed undertheNational ChildhoodVaccine InjuryAct of1986,as amended, except as otherwisenotedinparagraph12above. Thereis absolutelynoagreement onthepart ofthe parties hereto tomakeanypayment ortodoanyact orthingotherthanis hereinexpresslystated andclearlyagreedto. Petitionerherebyauthorizes respondent todisclosedocuments filedbypetitionerin this caseconsistent withthePrivacyAct andtheroutineuses describedintheNational Vaccine InjuryCompensationProgram System ofRecords, No.09-15-0056. 22. This Stipulation shall not beconstruedas an admissionbythe UnitedStates orthe SecretaryofHealthand HumanServices that the vaccine causedorsignificantlyaggravated B.B.’s alleged ADEM or neuromyelitis opticaoranyotherinjuryorcondition. 23. All rights andobligations ofpetitionerhereundershall applyequallyto petitioner’s heirs,executors,administrators,successors,and/or assigns as legal representatives ofB.B.
