Lucianna Dilsaver v. HHS - Influenza, dermatomyositis and necrotizing autoimmune myopathy (2019)

Lucianna Dilsaver filed a petition on June 20, 2016, alleging that she suffered from dermatomyositis and necrotizing autoimmune myopathy as a result of an influenza vaccine received on October 8, 2014. She further alleged that she experienced residual effects for more than six months.

Respondent denied that the flu vaccine caused her condition. However, both parties agreed to settle the case through a stipulation filed on July 25, 2019.

The stipulation awarded Lucianna Dilsaver a lump sum of $206,244.00 for first-year life care expenses, combined lost earnings, pain and suffering, and past unreimbursable expenses. Additionally, an amount sufficient to purchase an annuity contract was awarded.

This award represents compensation for all damages to which Petitioner is entitled. The decision was issued by Special Master Brian H.

Corcoran on August 29, 2019, approving the stipulation and directing entry of judgment.
