Shelly M. Pinckard v. HHS - Influenza, left shoulder injury (2017)

Shelly M. Pinckard filed a petition for compensation under the National Vaccine Injury Compensation Program, alleging a left shoulder injury following her September 19, 2013 influenza vaccination.

Pinckard agreed with the amounts set forth in the proffer. The decision awarded a lump sum payment of $1,845,047.00, which included amounts for future life care expenses, past unreimbursable expenses, past and future pain and suffering, and past and future loss of earnings.

Additionally, an amount sufficient to purchase an annuity contract for future medical expenses, medications, and supplies and equipment was awarded. These amounts represent compensation for all damages available under the Vaccine Act.

The clerk of the court was directed to enter judgment in accordance with this decision.
