Lu Ann Kendrick v. HHS - Influenza, right shoulder injuries (2016)

Lu Ann Kendrick filed a petition for compensation under the National Vaccine Injury Compensation Program on September 22, 2016, alleging that she suffered right shoulder injuries caused by an influenza vaccination she received on December 2, 2014. She stated that she received the vaccination in the United States, continues to suffer from the effects of her injuries, and has not received prior compensation for vaccine-caused injuries.

Respondent denied that the flu vaccine caused petitioner's alleged SIRVA or any other injury. Despite the denial, the parties filed a joint stipulation on September 21, 2016, agreeing that compensation should be awarded.

The Chief Special Master found the stipulation reasonable and adopted it as the Court's decision. Lu Ann Kendrick was awarded a lump sum of $50,000.00, representing compensation for all eligible damages.

The clerk was directed to enter judgment in accordance with this decision.
