Estate Of David E. Nawatny v. HHS - Influenza, Systemic Inflammatory Response Syndrome (SIRS) (2019)

The Estate of David E. Nawatny, represented by Donna Nawatny, filed a petition for compensation under the National Vaccine Injury Program after Mr.

Nawatny received an influenza vaccine on October 10, 2013. The petitioner alleged that the flu vaccine caused Mr.

Nawatny to suffer from Systemic Inflammatory Response Syndrome (SIRS) and that his subsequent death was a sequela of this vaccine-related injury. The respondent, the Secretary of Health and Human Services, denied that the flu vaccine caused the alleged injuries or death.

Despite maintaining their respective positions, the parties reached a stipulation to settle the issues and award compensation. The stipulation provided for a lump sum payment of $115,000.00 to the petitioner, representing compensation for all damages.

The Special Master adopted the parties' stipulation and awarded the compensation. The decision was filed on July 11, 2019.
