Michael Purcell v. HHS - Influenza, viral encephalitis and acute retinal necrosis (2016)

Michael Purcell filed a petition for compensation under the National Vaccine Injury Compensation Program on July 23, 2015, alleging he developed viral encephalitis and acute retinal necrosis as a result of receiving influenza vaccinations on October 30, 2012, October 17, 2013, and October 18, 2014. Respondent denied that the influenza immunization caused petitioner's injuries.

The parties subsequently filed a joint stipulation agreeing to settle the case. Respondent agreed to issue a payment of $325,000.00 as compensation for all damages.

The Special Master adopted the stipulation and awarded compensation in that amount. Later, on November 29, 2016, petitioner filed an unopposed motion for attorneys' fees and costs, requesting $42,962.50 in fees and $6,398.04 in costs.

The Special Master awarded $49,273.04, to be paid jointly to the petitioner and his counsel.
