Troy Turner v. HHS - Influenza, Guillain-Barré syndrome (2016)

Petitioner Troy Turner filed a petition for compensation under the National Vaccine Injury Compensation Program on April 20, 2015. He alleged that he suffered from Guillain-Barré syndrome (GBS) as a result of receiving an influenza vaccine on February 7, 2014, and that he experienced residual effects from the injury for more than six months.

The respondent, the Secretary of Health and Human Services, denied that the flu vaccine caused Mr. Turner's GBS or any other injury.

Despite the respondent's denial, the parties filed a joint stipulation on March 14, 2016, agreeing that a decision should be entered awarding compensation. Chief Special Master Nora Beth Dorsey found the stipulation reasonable and adopted it as the decision of the Court.

Mr. Turner was awarded a lump sum of $50,000.00, payable to him, as compensation for all items of damages available under the Vaccine Act.
